Pregnancy Discrimination Attorney

Discriminating against an employee because they are pregnant has been illegal since 1978.

It still occurs but is usually subtle and sometimes difficult to detect. It’s usually obscured by something that on its face seems like an everyday work event and easily explained – like a promotion going to another employee.

No matter what form it takes or how it manifests itself, discrimination against a pregnant employee  is illegal. You do not need to accept it. You can fight back – with Hux Law Firm, LLC’s help.

What is Pregnancy Discrimination?

The Pregnancy Discrimination Act of 1978, written into Title VII of The Civil Rights Act of 1964, prohibits discrimination against pregnant workers.

Pregnancy discrimination in the workplace takes many forms and can occur anytime – even during the hiring process. It is unlawful to discriminate against someone because of their pregnancy when it comes to the terms, conditions, or benefits of employment including promotions, terminations, layoffs, compensation, job assignments, discipline, and training.

In addition, employers must accommodate pregnant employees if those accommodations would allow the employee to continue to work. Reasonable accommodation includes additional medical leave and a return to work at less than full time.

How Do I Know It’s Pregnancy Discrimination?

A pregnant employee is protected from termination or discipline solely because of the pregnancy. Pregnancy should never be a factor when considering pay, promotions, work evaluations, or any other work related issues.

Not every employer follows this simple rule.

If a business:

  • Hires someone less qualified than you.
  • Terminates your employment despite good performance reviews.
  • Pays work peers more than you.
  • Promotes under qualified employees over you.
  • Lays you off despite seniority or expertise.
  • Imposes unfair or disproportionate disciplinary action.

…and pregnancy was a factor, your rights have been violated.

What to Do

Report it – in writing – to the Human Resources department. The sooner the better. Then document everything you can from performance reviews to emails and notices. As you’re doing that seek professional help – these complaints are complex, the support of an attorney well versed and experienced in employment discrimination matters is essential.
